PERAN BAGIAN HUKUM SEKRETARIAT DAERAH DALAM PROSES PEMBENTUKAN PERATURAN DESA

Abstract

Village Regulations (Peraturan Desa) are legal instruments that regulate governance, development, and community empowerment at the village level; therefore, their formation must comply with higher legal norms and principles of proper legal drafting. This study aims to analyze the role of the Legal Division of the Regional Secretariat of Sikka Regency in assisting and supervising the process of forming Village Regulations. The research applies a qualitative descriptive method based on field experience during an internship program, supported by observation, participation in legal assistance activities, and analysis of relevant legal documents and regulations. The findings show that the Legal Division plays a strategic role in facilitating, guiding, and evaluating the drafting of Village Regulations to ensure their conformity with existing laws and legal drafting standards. During the internship period, approximately sixty villages consulted the Legal Division regarding the preparation of village legal products, particularly regulations on village capital participation, village authority, and the establishment of Village Legal Aid Posts. However, several challenges were identified, including limited understanding of legal drafting among village officials and incomplete administrative documents.
